Особенности Ограничения Правосубъектности Юридического Лица, Не Способного Удовлетворить Требования Кредиторов

Abstract

Одной из сторон в отношениях, возникающих при введении процедур несостоятельности (банкротства), является должник. По определению, должником может выступать физическое или юридическое лицо, которое обязано совершить в пользу другого лица (кредитора) определенное действие, например, передать имущество, выполнить работу, уплатить деньги и т.п., либо воздержаться от определенного действия. Во исполнение указанных действий, должник претерпевает определенные правовые последствия, например, ограничивается его возможность совершать определенные действия или принимать решения.
