Право На Неприкосновенность Частной Жизни: Юридическая Характеристика И Проблемы Реализации

Abstract

Статья посвящена одному из основных конституционных прав человека и гражданина. В работе представлены позиции разных ученых относительно понятия права на неприкосновенность частной жизни, проанализированы признаки данного права. Основываясь на его сущностных характеристиках, автором дано собственное определение рассматриваемого права. В статье отмечено, что данное право подвергается определенным ограничениям, и сферой наиболее существенных его ограничений является оперативно-розыскная и уголовно-процессуальная деятельность; указано на низкую эффективность уголовно-правовой защиты права на неприкосновенность частной жизни, тем самым обозначены проблемы реализации данного права; сделан вывод о том, что с учетом положений основных международно-правовых актов в области прав человека и складывающейся правоприменительной практики вероятно наполнение рассматриваемого права новым содержанием.
