О Субъекте Обвинения И Его Функциях На Предварительном Слушании

Abstract

С 1 июля 2002 года вступил в законную силу Уголовно-процессуальный кодекс Российской Федерации, установивший предварительное слушание как особую форму подготовки дела к судебному заседанию. В настоящее время в юридической литературе так и не сложилось единого мнения по вопросу о правовой природе деятельности прокурора в данной стадии. От правильного разрешения обозначенного вопроса, а, следовательно, и от выполняемых прокурором функций, зависит дальнейшее рассмотрение уголовного дела по существу в стадии судебного разбирательства.
