Направления Повышения Эффективности Функционирования Института Банкротства

Abstract

Исследуются проблемы института банкротства, статистические данные о совершенных преступлениях в этой сфере, анализируются способы повышения эффективности функционирования института банкротства России. Особое внимание уделено необходимости повышения требований к уровню профессионализма всех участников дел о банкротстве, в том числе арбитражных управляющих, работников банковской сферы деятельности и других участников процедур несостоятельности, знания ими нормативной законодательной базы института банкротства. Исследуется особая роль экспертов в делах о банкротстве ввиду наличия множества претензий к уровню обоснованности их заключений, обосновывается целесообразность повышения требований к знанию ими законодательной базы сферы деятельности, подлежащей экспертизе института банкротства, а также необходимость применения медиативных технологий в рамках внесудебного урегулирования споров.
