Современное Состояние Латентной Преступности В Сфере Интеллектуальной Собственности

Abstract

Целью написания данной статье послужили результаты проведенного исследования латентной преступности в сфере интеллектуальной собственности, которые основывались на научных работах российских (С.М. Иншаков, А.А. Конев, и др.) и зарубежных ученых ((Брюс Александр и Мак Дональд, США, Франциско Хесус Альманса Монтойя, Испания). В статье представлен краткий анализ методик определения уровня латентности интеллектуальной собственности, дана характеристика особенностей латентной преступности рассматриваемого вида. Автор в работе делает вывод о том, что уголовная статистика не отражает действительное состояние преступности в сфере интеллектуальной собственности, она является высоколатентной, но играет незначительную роль, либо не оказывает сколько-нибудь значительного влияния на преступность в целом. Результаты исследования, представленные в статье, будут полезны при изучении причинного комплекса преступлений, совершаемых в сфере интеллектуальной собственности и подготовке форм и методов борьбы с данным видом преступлений.
