Залог недвижимости (mortgage) и его виды в праве Индии

Abstract

В рамках данной статьи автор исследует понятие, правовая природа, а также виды залога недвижимости, как способа обеспечения исполнения обязательств в праве Индии, а также особенности договора залога недвижимости в правоприменительной практике Индии. При подготовке данной статьи автором использовался диалектический метод анализа, научно-познавательные возможности которого позволяют выделить залог недвижимости в системе способов обеспечения обязательств в праве Индии. В рамках исследования автором использовались также работы английских ученых правоведов, таких как: Phillip R.Wood, Sulton and Shannon, Charles Proctor, Sir Dinshaw Fardunji Mulla. По итогам работы были сделаны выводы о преемственности залогового права Индии английскому колониальному праву, а также о том, что аномальный залог недвижимости (anomalus mortgage), узуфруктарный залог недвижимости характерны исключительно для законодательства Индии.
