Юридическая Квалификация Лизинговых Отношений В Части Приобретения Лизингодателем Права Собственности На Предмет Лизинга

Abstract

В статье автор, определяет правовую конструкцию фидуциарного залога опираясь на лизинговое, залоговое законодательство и мировую практику его применения. В основе предложенной юридической модели лежат имущественные интересы сторон в частности лизингодателя, лизингополучателя и продавца предмета лизинга. Для решения проблемы адекватного отображения экономических отношений сторон лизингового соглашения в статье определяется механизм действия фидуциарного залога в договоре лизинга, кроме того определено понятие и правовые особенности фидуциарного залога как способа обеспечения основного обязательства по возврату денежных средств лизингополучатем, предоставленных лизингодателем на получения определенного имущества лизингополучателем
