Abstract

Анализ составов преступлений, входящие в понятие рейдерских захватов. Распространение действий рейдеров на группы предприятий (сети), на предприятия, связанные технологической цепочкой либо крупный бизнес, получивших транснациональное значение. Глава 22 УК РФ, определяющая виды уголовно наказуемых деяний, совершаемых в сфере экономической деятельности. Квалификация рейдерского захвата, отграничение захвата предприятия от рейдерской атаки или недружественного поглощения. Насильственный характер действий по захвату предприятия возможен посредством использования организованной силы (преимущественно вооруженной) законных силовых структур, незаконных вооруженных формирований либо массового участия граждан, а также демонстрации готовности применить силу. Схемы рейдерских захватов инициация банкротства по небольшой задолженности, подделка различных документов, силовой захват, миноритарный шантаж, «белая схема»
