Законодательное Разрешение Проблемы Эвтаназии В Зарубежных Странах И России

Abstract

Представленная статья является результатом рассмотрения существующих подходов к проблеме легализации эвтаназии в зарубежных странах. На основе анализа автор проводит систематизацию стран на государства, которые полностью легализовали эвтаназию в пассивной и активной формах; в которых разрешена только пассивная эвтаназия; которые регулируют вопросы эвтаназии путём принятия судебных прецедентов; которые отрицают само существование права на смерть как юридический факт и предусматривают уголовную ответственность за эвтаназию; которые предусматривает уголовную ответственность не только за эвтаназию, но и за содействие в её проведении. В России проблема эвтаназии не урегулирована в законодательном порядке, в связи с чем автором предлагается путь использования Россией положительного зарубежного опыта с перспективой поэтапной ее легализации
