Юридическая Ответственность: Правовой Анализ Данного Явления

Abstract

В статье рассматриваются современные проблемы юридической науки. Цель: провести правовой анализ такого явления, как юридическая ответственность. Задачи: рассмотреть основные теоретико-правовые аспекты юридической ответственности. Методы: методологическую основу юридической ответственности составляет диалектический подход к исследованию социальной реальности. Выводы: автором исходя из анализа положений действующего законодательства и мнения ученых-правоведов делается попытка рассмотреть правовую природу такого явления, как юридическая ответственность, провести определенный правовой анализ, указать на основные аспекты понятия, что особенно важно при рассмотрении данного вопроса. На самом деле, в правовой науке отсутствуют единые подходы к определению явления «юридическая ответственность», а установленное применение в основном определяется законодательно, что в конечном итоге сказывается на качестве законности и правопорядка в государстве. В статье не только раскрывается понятие юридической ответственности, но и проводится необходимое его анализирование.
