Преддоговорная Ответственность: Проблемы Юридической Квалификации В Международном Частном Праве

Abstract

Статья посвящена мало исследованной проблеме в доктрине международного частного права, а именно: ответственности за недобросовестное ведение переговоров о заключении трансграничной сделки. Автор рассматривает основания возникновения преддоговорной ответственности, приводит существующие в доктрине точки зрения относительно оснований возникновения такой ответственности. Анализируется природа преддоговорной ответственности и подходы, существующие в различных государствах. Автор уделяет внимание коллизионному регулированию ответственности за недобросовестное ведение переговоров и изучает коллизионное регулирование ответственности за недобросовестное ведение переговоров, закрепленное в Регламенте Европейского Союза от 11 июля 2007 г. о праве, подлежащем применению к внедоговорным обязательствам Рим II и Гражданском кодексе РФ.
