Особенности Изъятия Электронных Доказательств По Уголовным Делам

Abstract

В научной статье рассматриваются актуальные вопросы и проблемы уголовно-процессуального права в сфере изъятия электронных доказательств. Раскрыт правовой статус электронных доказательств, особенности процедуры выемки электронных доказательств, юридическая природа и необходимость участия специалиста в следственных действиях. Проанализированы также такие процессуальные действия как «Получение информации о соединениях между абонентами и (или) абонентскими устройствами», «Наложение ареста на почтово-телеграфные отправления, их осмотр и выемка», «Контроль и запись переговоров». По результатам исследования выработаны предложения по внесению изменений в уголовно-процессуальное законодательство.
