Abstract

Статья посвящена рассмотрению спорных вопросов, возникающих при уголовно-правовой оценке преступного заражения венерической болезнью и ВИЧ-инфекцией. Автор дает анализ точек зрения ученых по вопросу определения непосредственных объектов преступлений, предусмотренных ст. ст. 121, 122 УК РФ. Исследуется позиция законодателя о размещении составов преступного инфицирования в главе 16 раздела VII («Преступления против жизни и здоровья человека»). Кроме того, анализируется понятие «специальный» потерпевший, обозначенный в качестве конструктивного признака составов преступлений, предусмотренных ст. ст. 121, 122 УК РФ.
