Субъект И Субъективная Сторона Состава Нарушения Требований Пожарной Безопасности

Abstract

В статье рассмотрены дискуссионные вопросы установления субъекта и субъективной стороны преступления, предусмотренного статьей 219 УК РФ. Обосновывается авторское представление о том, что субъектами рассматриваемого преступления могут быть как должностные лица, так и граждане, на которых была возложена определенная обязанность по соблюдению противопожарных правил, и они были ознакомлены с этими правилами или имели реальную возможность ознакомиться, но не сделали этого вопреки предписаниям правил. Сделаны вывод о наличии дополнительных признаков субъекта преступления, предусмотренного ст.219 УК РФ, характеризующих его статус, а также определены основные признаки субъективной стороны преступления, которыми следует руководствоваться при установлении факта нарушения требований пожарной безопасности
