Abstract

В статье рассматривается вопрос законности изъятия, в том числе путем выкупа, земель для государственных или муниципальных нужд для целей недропользования. Проводится анализ норм российского законодательства, которые устанавливают упрощенный порядок оформления прав недропользователя на землю, находящуюся в государственной или муниципальной собственности, и норм, устанавливающих возможность изъятия у частного собственника земель для государственных или муниципальных нужд для целей недропользования при недостижении сторонами договоренности о продаже земельного участка или предоставлении его на правах аренды. Автор приходит к выводу о том, что отношения между недропользователем и частным собственником должны строиться на принципе диспозитивности, присущем гражданскому праву
