Abstract

Задача. Изучение проблемы применения реорганизационных мер в рамках реабилитационных процедур. В России применение данного механизма ограниченно отсутствием надлежащего правового регулирования. Модель. В ходе изучения данной проблемы автор опирался на теоретические исследования российских и зарубежных ученых, использовался сравнительно-правовой метод, также применялась статистика применения реабилитационных процедур в ходе банкротства. Выводы. Автором выявлены причины, препятствующие эффективному применению мер по реорганизации предприятия-должника, а также предложены пути совершенствования законодательства для более эффективного применения данного механизма.
