Lex mercatoria как источник регулирования трансграничного обращения ценных бумаг

Abstract

Задача. Статья посвящена анализу lex mercatoria как одного из источников регулирования трансграничного обращения ценных бумаг. При изучении указанного вопроса были использованы работы Алимовой Я., Аблезговой О., Бахина С., Голдштейна А., Шмиттгоффа С. и др. Модель: В статье проанализированы положения правил и типовой документации, разработанных Международной ассоциацией свопов и деривативов (ISDA), Международной ассоциацией по займам ценных бумаг (ISLA), Международной ассоциацией рынков капитала (ICMA). Выводы: Сделан вывод о важности разработки и использования новых современных lex mercatoria при регулировании трансграничного обращения ценных бумаг, а также о необходимости дальнейшего развития деятельности международных неправительственных организаций в этой области
