Взаимосвязь Уголовно-Процессуальных Норм С Иными Нормами, Устанавливающими Безопасность Защищаемых Лиц В Уголовном Судопроизводстве

Abstract

В работе рассмотрены основные проблемы взаимосвязи и противоречивости отдельных норм Уголовного кодекса Российской Федерации и Уголовно-процессуального кодекса Российской Федерации, регулирующие защиту участников уголовного процесса. Установлено противоречие в способах воздействия (ч. 2 ст. 309 УК) и основаниях применения мер безопасности (ч. 3 ст. 11 УПК). Предложены пути устранения несогласованности норм и обоснование межотраслевого единообразия.
