Самозащита Гражданских Прав В Договорных Отношениях По Законам Древнего Рима

Abstract

Данная статья посвящена рассмотрению процесса становления и развития института самозащиты гражданских прав в Древнем Риме. В работе анализируются в хронологическом порядке изменения законодательства о самозащите и выявляются предпосылки этих изменений, связанные с усложнением социальной структуры Римского общества и усилением государственной власти. Актуальность данной статьи обусловлена тем, что Римское частное право в процессе своего существования прошло полный цикл от применения самозащиты гражданских прав, как стандарта поведения, до ее полного запрета. Материал статьи основан на подробном анализе Древнеримских законов и обычаев, касающихся самозащиты гражданских прав в различные исторические периоды.
