Совместные (Международные) Следственные Группы - Новое Направление Международного Сотрудничества В Сфере Уголовного Судопроизводства: Проблемы И Перспективы Развития

Abstract

В статье исследуются проблемы, возникающие при осуществлении компетентными органами Российской Федерацией международного сотрудничества в сфере уголовного судопроизводства. Институт совместных (международных) следственных групп является одним из новых направлений международного сотрудничества в сфере уголовного процесса, который требует детального исследования. Совместные расследования упростят процедуру обращения с запросами о правовой помощи по уголовным делам, помогут преодолеть проблемы, связанные с собиранием, оценкой доказательств и т.д. Над данным направлением работают и зарубежные ученые [Judit Nagy, 2009; Jürgen Kapplinghaus, 2007]. В данной работе рассмотрены теоретические и правовые основы института совместных (международных) следственных групп. В процессе исследования использовались диалектический метод научного познания и сравнительно-правовой метод
