О Необходимости Запроса Дополнительных Гарантий При Наличии Оснований Предполагать, Что Контрагент Не Исполнит Обязательство В Установленный Срок

Abstract

Статья рассматривает теоретические и практические аспекты применения ч.2 ст.328 ГК РФ, допускающей применение самозащиты, посредством приостановления или отказа от исполнения обязательства стороной на которой лежит встречное исполнение обязательства, при наличии обоснованных оснований предполагать, что другая сторона не произведет исполнение в установленный срок. Актуальность данной статьи обусловлена тем, что вопрос о критериях законности самозащиты в случае предвидимого нарушения, практически не урегулирован законодательством, что приводит к серьезным противоречиям в правовой литературе и правоприменительной практике. Материал статьи основан на подробном анализе законодательства и судебной практики США, которые выработали в настоящее время достаточно эффективный способ решения исследуемой проблемы и высказываемых в правой литературе мнений по изучаемому вопросу
