Частное Право: Принцип Взаимности Как Основание Для Признания И Исполнения Решений Иностранных Судов

Abstract

Статья посвящена вопросу о необходимости включения принципа международной взаимности в действующее законодательство как одного из основания для признания и исполнения решений иностранных судов. Автор считает, что если придерживаться принципа конвенциональной экзекватуры и ограничительно толковать и соответственно применять принцип взаимности, у России так и не появится возможности предоставить участникам процесса должную судебную защиту на территории нашей страны.
