Abstract

Многочисленные вопросы квалификации составов легализации (отмывания) денежных средств или иного имущества, приобретенных другими лицами преступным путем (ст. 174 УК РФ), а также легализации (отмывания) денежных средств или иного имущества, приобретенных лицом в результате совершения им преступления (ст. 174-1 УК РФ), заставляют в числе прочих путей решения обращаться к опыту зарубежного законодателя в рассматриваемом вопросе, поскольку от четкого и логичного формулирования соответствующих уголовно-правовых норм, как представляется, напрямую зависит процесс эффективного правоприменения. Положительным опытом в этом контексте в определенной мере вполне может стать французский законодатель, являющийся, как и российский законодатель, представителем романо-германской системы права.
