Социальная Обусловленность Уголовной Наказуемости

Abstract

Задача. В статье раскрывается дифференциация уголовной ответственности, которая относится к сфере правотворчества и в целом отражает направление развития уголовно-правовой политики Российского государства. Этим обусловлен ее динамизм. Модель. Анализу подвергаются уголовный закон, в который в последние годы вносится значительное количество изменений и дополнений, а их содержание порой диктуется конкретными резонансными событиями, происходящими в обществе. При этом принципы, цели, задачи уголовной ответственности необоснованно отодвигаются на второй план. Вывод. Дальнейшее совершенствование уголовной ответственности возможно также в связи с пересмотром ряда положений, касающихся категорий преступлений.
