Abstract

Статья посвящена вопросам определения необходимости назначения судебной экспертизы и возможности ее проведения. Автор обосновывает неточность формулировки цели проведения судебной экспертизы и несовершенство норм, регулирующих действия суда на этапе рассмотрения вопроса о назначения судебной экспертизы. В статье сделаны теоретические выводы о путях преодоления сложившейся ситуации и внесены предложения по совершенствованию действующего процессуального законодательства. Содержание статьи позволяет раскрыть значимость действий суда на этапе, предшествующем назначению судебной экспертизы в гражданском судопроизводстве. Статья может быть полезна студентам и аспирантам юридических ВУЗов, юристам, судьям, экспертам, ученым и преподавателям
