Основные Черты Исковой Формы Защиты В Арбитражном Процессе

Abstract

Статья посвящена исследованию основных черт исковой формы защиты в арбитражном процессе. Доказывается, что приспособленность процессуальной формы для решения имеющихся задач (рассмотрение и разрешение экономических споров) направлена на достижение оптимального соответствия между характером материальных отношений, составляющих объект судебной деятельности, и способом организации этой деятельности. Рассматриваются черты, которые присущи экономическому спору как подвиду спора о праве, и их влияние на формирование специфики исковой формы защиты в арбитражном процессе, реализуются в способе организации отдельных процессуальных действий, процедур и стадий. На основании сравнительного анализа формулируются основные характеристики исковой формы защиты прав и интересов субъектов предпринимательской и иной экономической деятельности.
