Обзор Основных Причин Отказа В Признании И Приведении В Исполнение Иностранных Арбитражных Решений На Территории Китая

Abstract

В настоящей статье автор проводит обзор основных причин отказа признания и приведения в исполнение иностранных арбитражных решений на территории Китая. Основной акцент уделяется основаниям, предусмотренным подпунктами «b» и «d» пункта 1 и подпунктом «а» пункта 2 статьи 5 Нью-Йоркской конвенции «О признании и приведении в исполнение иностранных арбитражных решений», а именно: сторона, против которой вынесено арбитражное решение, не была должным образом уведомлена о назначении арбитра или об арбитражном разбирательстве или по другим причинам не могла представить свои объяснения; состав арбитражного органа или арбитражный процесс не соответствовали соглашению сторон или при отсутствии такового не соответствовали закону той страны, где имел место арбитраж; объект спора не может быть предметом арбитражного разбирательства по законам этой страны.
