Abstract

Задача исследование проблем развития судопроизводства в эпоху «просвещенной монархии». Модель/методология анализ подходов и взглядов исследователей на развитие судебного процесса на рубеже двух столетий, когда были предприняты попытки либерализации общественных отношений. Выводы в статье анализируются особенности трактовки изменений элементов судебного производства в переходный период от абсолютной монархии к «просвещенной». Оригинальность / ценность данная статья затрагивает проблемы, предполагающие необходимость анализа вопроса о степени самостоятельности монархической власти в плане потенциальных возможностей разрушения сложившихся в обществе представлений об основных принципах судебного разбирательства в России
