О Состязательной Форме Уголовно-Процессуального Доказывания И Использовании «Электронных Доказательств»

Abstract

В статье обосновывается необходимость укрепления состязательности доказывания в виду все более широкого использования электронных доказательств. Следственный процесс предполагает односторонний характер интерпретации фактических данных об обстоятельствах дела. Расследование преступлений с использованием электронных доказательств делает необходимым привлечение специальных познаний. Судье должны быть представлены конкурирующие интерпретации имеющейся электронной информации, чтобы он мог всесторонне оценить ее. Без качественных изменений процедуры уголовно-процессуального доказывания невозможно внедрение новых информационных технологий и соблюдения прав личности
