Руководитель Акционерного Общества Как Представитель Работодателя В Отношениях По Социальному Партнерству

Abstract

Статья посвящена роли руководителя акционерного общества как представителя работодателя в отношениях по социальному партнерству. Используя системно-структурный и сравнительно-правовой методы научного исследования, автор показал, что руководитель акционерного общества, являясь представителем работодателя в отношениях по социальному партнерству, играет ключевую роль в системе социального партнерства на локальном уровне. В статье раскрывается объем полномочий, которыми закон наделяет руководителя в области социального партнерства, характер и содержание его прав и обязанностей в этой сфере. В заключении также рассматриваются вопросы юридической ответственности такого руководителя. Сформулированные в статье положения могут быть использованы в целях дальнейшего изучения проблем правового регулирования отношений, возникающих в сфере трудоправового статуса руководителя акционерного общества, а также могут быть использованы при разработке конкретных мер, направленных на совершенствование законодательства в этой области.
