Проблемы Законодательного Установления Порядка Увольнения Работников За Нарушение Трудовой Дисциплины

Abstract

ТК РФ, устанавливая основания для увольнения работников по инициативе работодателя, формулирует их не всегда полно, что порождает проблемы, связанные с различным толкованием этих норм участниками процесса труда. Кроме того, для признания увольнения законным, необходимо соблюсти порядок увольнения, который не всегда четко установлен в законе, поэтому каждый правоприменитель определяет его по-своему. В статье раскрываются проблемы законодательного установления порядка увольнения работников по инициативе работодателя за нарушение трудовой дисциплины. При этом обращается внимание как на недостатки законодательства в части определения порядка наложения дисциплинарных взысканий, так и на неполноту отражения в нем специального порядка увольнения, который предопределяется самой формулировкой увольнения. Автор вносит свои предложения по совершенствованию действующего порядка увольнения работников за нарушение трудовой дисциплины
