Особенности Правового Статуса Главы Органа Местного Самоуправления Как Субъекта Особо Квалифицированного Состава Получения Взятки

Abstract

Статья посвящена анализу правового статуса главы органа местного самоуправления как субъекта особо квалифицированного состава получения взятки, так как этот вопрос является дискуссионным в науке уголовного права. Автор исследует вопрос о том, кого имел в виду законодатель, указывая в УК РФ в качестве главы органа местного самоуправления: то ли главу муниципального образования, являющегося высшим должностным лицом муниципального образования, то ли руководителей органа муниципального образования, включая руководителей представительного органа муниципального образования, исполнительно-распорядительного органа муниципального образования (главу местной администрации являющуюся главой муниципального образования). По мнению автора необходимо изменить часть 4 ст. 290 УК РФ, где вместо слов «а равно главой органа местного самоуправления», указать «а равно руководителей органов местного самоуправления», при этом, под такими лицами будут пониматься как руководители представительного органа муниципального образования, так и местной администрации, глава муниципального образования, что упростит реализацию правоприменителю данной нормы.
