Некоторые Вопросы Квалификации Заранее Не Обещанного Укрывательства Преступлений

Abstract

В настоящей статье проводится анализ практики применения ст.316 УК РФ, рассматриваются проблемные вопросы, связанные с квалификацией заранее не обещанного укрывательства преступлений, определением отграничительных признаков этого преступления от других видов преступной деятельности, а также делается вывод о необходимости принятия нового постановление Пленума Верховного суда РФ, посвященного обобщению судебной практики по данным преступлениям, содержащего рекомендации по актуальным вопросам их квалификации, для сокращения количества ошибок в правоприменительной деятельности. Полученные выводы могут использоваться для разработки предложений по совершенствованию уголовного законодательства, обеспечивающего охрану интересов правосудия, в целом, и нормы, предусматривающей ответственность за заранее не обещанное укрывательство, в частности
