Abstract

В статье анализируется современное состояние правового регулирования и судебно-арбитражной практики по вопросам, связанным с внесением платы при пользовании недрами, с позиций выделяемого в юридической науке принципа платности недропользования. В целях совершенствования законодательства вносятся предложения по дальнейшей кодификации законодательства о налогах и сборах (в части регулярных платежей за пользование недрами) и предложения по совершенствованию правового регулирования в рамках горного законодательства Российской Федерации (в части разовых платежей за право пользования недрами).
