Система Понятий, Используемых Для Обозначения Жилья В Российском Праве

Abstract

дается характеристика понятиям «жилище», «жилое помещение»; правовая категория жилое помещение рассматривается с точки зрения олицетворения национального (базового) стандарта жилища, установленного государством; анализируется система взглядов Европейского Суда по правам человека под названием «концепция жилища», развивающаяся от прецедента к прецеденту; рассматривается вопрос диффузии междисциплинарных понятий «жилища» и «жилого помещения» в связи с процессом интеграции государства в единое правовое и экономическое европейское пространство; выявляются недостатки легального определения «жилое помещение», как не отражающего его сути, целевого назначения, и многообразия форм его существования, в связи с чем делается основной вывод о внесении изменений в статьи 15 и 16 Жилищного кодекса.
