Проблемы Применения Законодательства В Деятельности Правоохранительных Органов По Борьбе С Преступными Сообществами В Сфере Незаконного Оборота Наркотиков

Abstract

В статье на конкретных примерах и на основе статистических данных МВД, ФСКН Росси показывается динамика роста преступлений, совершенных преступным сообществом (преступной организацией) в сфере незаконного оборота наркотиков. Тем самым аргументируется актуальность и необходимость рассмотрения проблем, с которыми сталкиваются правоохранительные органы при выявлении, документировании и расследовании этой категории уголовных дел. Указывается на необходимость внесения соответствующих изменений в текст уголовного и уголовно-процессуального закона (в частности применения ст. 181 УПК РФ), либо принятие исходящего от законодателя комментария к соответствующим нормам, которые помогли бы отразить криминальные реалии.
