Abstract

Не отрицая положений статьи 486 ГК РСФСР о том, что авторские права на телефильм принадлежат киностудии, автор на основании изученного законодательства СССР, архивных и финансово − бухгалтерских документов, анализирует пределы этих авторских прав с позиций не только авторского права, но и с позиций анализа нормативного регулирования творческого процесса производства телефильмов, сути телефильма, который являлся не только особым объектом авторского права, но и особым имуществом юридического лица − основным средством, специальной правоспособности киностудий, как государственного юридического лица. Автор обосновывает свои выводы о том, что имущественные права на телефильмы, созданные по заказу Гостелерадио СССР, всегда принадлежали государству и продолжают ему принадлежать.
