К Вопросу О Проблемах Перехода Прав Требования И Долгов При Передаче Предприятия В Аренду

Abstract

В статье раскрываются проблемы правового регулирования перехода имущественных прав и обязанностей в составе арендованного предприятия в контексте соотношения общих и специальных норм о переводе долга и цессии. Специальному исследованию подвергается положение ст. 657 ГК РФ, в результате которого автор делает ряд рекомендаций по его совершенствованию. Детально рассматриваются вопросы о последствиях пропуска кредитором установленного законом срока для дачи ответа на уведомление арендодателя о передаче предприятия в аренду, возможности перевода долга в рамках договора аренды предприятия без согласия кредитора, а также о сроке солидарной ответственности арендатора и арендодателя по включенным в состав переданного предприятия долгам, которые были переведены на арендатора без согласия кредитора.
