Общественная Нравственность Как Объект Уголовно-Правовой Охраны

Abstract

В настоящей статье рассматривается вопрос возможности определения нравственности в качестве объекта преступления. Нравственность определяется как объект уголовно-правовой охраны в виде общепризнанной системы ценностей человека в конкретном обществе и определяемой через основные категории философии, такие как свобода, добро, справедливость и другие категории. Нами ставится под сомнение правильность формулирования объекта преступлений, закрепленных в главе 25 Уголовного кодекса РФ, как общественной нравственности. На наш взгляд, нравственность должна являться объектом уголовно-правовой охраны, однако не в том смысле и не в тех пределах, которые сейчас заложены в Уголовном кодексе РФ.
