Abstract

в статье на основе анализа действующего уголовного законодательства выделяются виды преступлений, посягающих на лиц в связи с их служебной или иной специально предусмотренной законом социально необходимой деятельностью, выполнением общественного долга либо их близких, определены в нормах, содержащихся в двадцати шести статьях УК РФ. Раскрываются понятия «служебная деятельность», «иная специально предусмотренная законом социально необходимая деятельность», «выполнение общественного долга», «близкие». Приводится обоснование, согласно которому содержащееся в ч. 3 п. 6 постановления Пленума Верховного Суда РФ от 27 января 1999г. № 1 «О судебной практике по делам об убийстве (ст. 105 УК РФ)» толкование понятия «близкие» поможет быть распространено на все другие нормы УК РФ, в которых употреблён этот термин.
