Abstract

Статья посвящена унификации понятий: принципы права, процессуальные принципы. Проведено исследование классификационных и содержательных аспектов гражданско-процессуальных и уголовно-процессуальных принципов, посредством анализа различных подходов. Примечательно, что принципом для уголовного и гражданского процесса являются правовые положения, нашедшие законодательное закрепление, то есть обладающие признаками: формальной определенности, общеобязательностью, властностью, нормативностью, осуществляющие свою реализацию по разному, в зависимости от стадии процесса. Особое значение в статье уделено необходимости выделения институциональных принципов, помимо общеправовых, межотраслевых, отраслевых.
