Гражданское Законодательство Российской Империи В Дореволюционной Правовой Мысли: К Историографии Вопроса

Abstract

В статье проводится историографический анализ цивилистической правовой мысли в дореволюционной России XVIII-XIX вв. Автором предлагается и обосновывается выделение этапов эволюции правовых идей в имперский (дореволюционный) период развития российского гражданского права. Делается обзор, определяется историко-правовое значение работ Д. И. Мейера, А. И. Кранихфельда, Н. Ф. Рождественского, С. В. Пахмана, Г. Ф. Фершеневича, К. Н. Анненкова и других авторов. Делается вывод, что историографический комплекс имперского периода имеет для исследования гражданского законодательства Российской империи в значительной мере фундаментальный характер, поскольку гражданское законодательство рассматривалось в процессе его становления и развития, с позиции практики правоприменения и в условиях достаточной источниковой информированности.
