Захват Заложника: Возмещение Вреда, Причиненного Жертвам Преступления

Abstract

Статья развивает тезис о том, что «уголовная политика не может и не должна быть либеральной во время разгула преступности» применительно к составам захвата заложника, иных преступлений террористического характера и актуализации проблемы возмещения потерпевшим причиненного им вреда. Проанализировав значительный массив событий захвата заложника, иных преступлений террористического характера, совершенных в России и за рубежом, положения иностранного и отечественного законодательства, посвященные борьбе с данными деяниями, автор, в частности, констатирует: оценивая соответствующие деяния как «вызовы» не столько потерпевшим, сколько государству и обществу в целом, в разных странах совершенствуют механизм возмещения вреда жертвам преступлений террористического характера, который функционирует на «стыке» норм публичного (уголовного) и частного (гражданского) права и позволяет потерпевшим не оставаться без справедливой компенсации, а бюджету без значительного урона.
