Применение Принципа Состязательности В Конституционных Судопроизводствах Европейских Государств

Abstract

Автор рассматривает применение одного из основополагающих принципов организации судебного процесса принципа состязательности, в конституционном судопроизводстве. В частности, рассматриваются такие его аспекты как: природа и функции данного принципа, его применение в зависимости от отдельных видов конституционных судопроизводств, исключения из данного принципа и т.п. Автор приходит к выводу, что различные аспекты данного принципа конституционного судопроизводства соответствуют его основным критериям, существующим в классических судопроизводствах.
