Диалектическая Логика Перехода От Недопустимости К Допустимости

Abstract

Недопустимость это такое же свойство относимых сведений, сопоставимое с допустимостью, имеющее свои, присущие ему признаки. С позиции диалектической логики ненадлежащие субъект, способ, процессуальное действие и форма фиксации здесь условия недопустимости. Для допустимости необходимо наличие всех условий этого свойства, для недопустимости достаточно наличия одного условия недопустимости, либо отсутствия (нарушения) хотя бы одного условия допустимости. Некоторые условия недопустимости не исключают возможности исправления нарушений, влекущих недопустимость доказательства. Значит, наличие всех условий недопустимости позволяет говорить об абсолютной недопустимости. Наличие условий недопустимости, в зависимости от характера самого нарушения, об относительной недопустимости.
