Abstract

В статье рассматривается исключительное право на товарный знак и распоряжение им. В настоящее время на мировом рынке действует около 20 млн. товарных знаков. В жестких условиях рынка, когда конкурируют не столько товары, сколько их товарные знаки, резко возрастает роль правовой охраны последних, появляется и динамично развивается новая форма передачи прав на использование товарных знаков, такая как франчайзинг.
