Отдельные Аспекты Реализации Предупреждения Как Административного Наказания Применяемого В Отношении Юридических Лиц

Abstract

В статье рассматривается актуальные вопросы назначения предупреждения в отношении юридических лиц, определяются критерии установления и применения предупреждения как административного наказания. Автором анализируются различные точки зрения на обозначенную проблему, а также исследуются отдельные составы административных правонарушений, наказанием за которые выступает предупреждение. Отдельно рассматривается нормы других отраслей права, предписывающие применение предупреждения. Исходя из анализа, автор дает рекомендации по изменению законодательства об административных правонарушениях в части регламентации санкций ряда статей КоАП РФ предписывающих назначение предупреждения юридическим лицам.
