Abstract

Учитывая значимость института государственной регистрации права на объекты недвижимости и популярность закрытых паевых инвестиционных фондов недвижимости в России, Федеральная служба государственной регистрации, кадастра и картографии в своей деятельности осуществляет интеграцию этих правовых институтов, в пределах своей компетенции решая возникающие в связи с этим проблемы. Существует большое количество вопросов, связанных с внесением в закрытый паевой инвестиционный фонд и выбытием из его состава недвижимого имущества, а также с отражением этих действий в Едином государственном реестре прав на недвижимое имущество и сделок с ним и выдачей правоустанавливающих документов, удовлетворяющих требованиям законодательства о государственной регистрации и об инвестиционных фондах. От правильности и обоснованности действий в этой сфере зависит защищенность прав собственников от захвата недвижимости.
