Предмет Вандализма: Понятие И Проблемы Законодательного Определения

Abstract

Статья посвящена исследованию вопроса определения предмета преступления, предусмотренного ст. 214 УК РФ «Вандализм». Автором раскрывается понятие предмета вандализма, приводится характеристика предметов материального мира, относящихся к предмету вандализма, рассматриваются проблемные аспекты вопроса (в частности, об отнесении к предмету преступления, предусмотренного ст. 214 УК РФ, культурных и исторических ценностей, мест захоронения и т.д.). Опираясь на анализ научного материала, результаты лично проведенного конкретно-социологического опроса, автор высказывает свое мнение о законодательной формулировке определения предмета вандализма.
