Abstract

Статья посвящена проблемам применения обратной силы уголовного закона. Сложившаяся на сегодняшний день правоприменительная практика дает основание утверждать, что обратная сила уголовного закона, наиболее благоприятного для виновного лица, фактически не реализуется и носит лишь декларативный характер. В рамках статьи автор исследует причины такого подхода, анализирует судебную практику, изучает существующие в правовой литературе предложения, направленные на устранение нарушения одного из фундаментальных принципов уголовного права.
